You used the template, and on it you put " copyright robert a ferris iii 2004" Implying that the site and design was yours.

You should make it clear that only the contents, and not the design was yours..

Not entirely correct. The content of these webpages is still his own work, and therefor, copyrightable (sp?).

Yes, but he doesn't make that clear at all.

If you saw a copyright notice on a website wouldn't you think that everything on the site, including the design, was included in that copyright?

To me it's the normal way to view a copyright notice on a website.

ok. I will change it. And just for the record, i had to do the design html and stylesheets for bafsoft.com myself. He just made the graphics. And the lion tamers site, they told me they wanted the same design.

ok, i clarified the copyright on bafsoft.net. And I am not the only one who uses oswd.org templates.... what is wrong with using them anyway?

There's nothing wrong with using them, in fact the authors of such templates are pleased for you to do so. But if you do use them I think it's common courtesy to credit the author of the design on your site, and not give the impression that you've made it.

Nothing is wrong with using premade designs.
Just make sure it's clear that you use them.
Something along the lines of:

Copyright 2004 FooBar
SiteDesign by WhoeverWhoDidIt (www.WhoeverWhoDidIt.com)
